Teilnahmebedingungen
Die Teilnahme am Gewinnspiel von Kramer-Werke, nachfolgend Betreiber oder Veranstalter genannt, ist kostenlos und richtet sich ausschließlich nach diesen Teilnahmebedingungen.
Ablauf des Gewinnspiels
Die Dauer des Gewinnspiels erstreckt sich bis von Montag, 04.12.2023 bis Mittwoch 06.12.2023, 24.00 Uhr.
Innerhalb dieses Zeitraums erhalten Nutzer online die Möglichkeit, am Gewinnspiel teilzunehmen.
Teilnahme
Um am Gewinnspiel teilzunehmen, ist ein Ausfüllen und Absenden des angezeigten Teilnahmeformulars notwendig. Die Teilnahme ist nur innerhalb des Teilnahmezeitraums möglich. Nach Teilnahmeschluss eingehende Einsendungen werden bei der Auslosung nicht berücksichtigt.
Pro Teilnehmer nimmt nur eine übermittelte Anmeldung am Gewinnspiel teil. Es ist strengstens untersagt, mehrere Email-Adressen oder mehrere Facebook Profile zur Erhöhung der Gewinnchancen zu verwenden.
Die Teilnahme am Gewinnspiel ist kostenlos.
Teilnahmeberechtigte
Teilnahmeberechtigt sind natürliche Personen, die Ihren Wohnsitz in Deutschland und das 14. Lebensjahr vollendet haben. Die Teilnahme ist nicht auf Kunden des Veranstalters beschränkt und nicht vom Erwerb einer Ware oder Dienstleistung abhängig.
Sollte ein Teilnehmer in seiner Geschäftsfähigkeit eingeschränkt sein, bedarf es der Einwilligung seines gesetzlichen Vertreters.
Nicht teilnahmeberechtigt am Gewinnspiel sind alle an der Konzeption und Umsetzung des Gewinnspiels beteiligte Personen und Mitarbeiter des Betreibers sowie ihre Familienmitglieder. Zudem behält sich der Betreiber vor, nach eigenem Ermessen Personen von der Teilnahme auszuschließen, wenn berechtigte Gründe vorliegen, beispielsweise
(a) bei Manipulationen im Zusammenhang mit Zugang zum oder Durchführung des Gewinnspiels, (b) bei Verstößen gegen diese Teilnahmebedingungen, (c) bei unlauterem Handeln oder (d) bei falschen oder irreführenden Angaben im Zusammenhang mit der Teilnahme an dem Gewinnspiel.
Gewinn, Benachrichtigung und Übermittlung des Gewinns
Folgende Preise werden vergeben: Eines von zehn exklusiven Kramer Christbaumkugelsets.
Die Ermittlung der Gewinner erfolgt nach Teilnahmeschluss im Rahmen einer auf dem Zufallsprinzip beruhenden Verlosung unter allen Teilnehmern. Ist das Gewinnspiel mit einer Aufgabe verknüpft, kommen ausschließlich diejenigen Teilnehmer in die Verlosung, welche die Aufgabe korrekt durchgeführt haben.
Die Gewinner der Verlosung werden zeitnah über eine gesonderte Nachricht über den Gewinn informiert.
Die Aushändigung des Gewinns erfolgt ausschließlich an den Gewinner oder an den gesetzlichen Vertreter des minderjährigen Gewinners. Ein Umtausch, eine Selbstabholung sowie eine Barauszahlung des Gewinns sind nicht möglich.
Eventuell für den Versand der Gewinne anfallende Kosten übernimmt der Betreiber. Mit der Inanspruchnahme des Gewinns verbundene Zusatzkosten gehen zu Lasten des Gewinners. Für eine etwaige Versteuerung des Gewinns ist der Gewinner selbst verantwortlich.
Meldet sich der Gewinner nach zweifacher Aufforderung innerhalb einer Frist von 3 Wochen nicht, kann der Gewinn auf einen anderen Teilnehmer übertragen werden.
Beendigung des Gewinnspiels
Der Veranstalter behält sich ausdrücklich vor, das Gewinnspiel ohne vorherige Ankündigung und ohne Mitteilung von Gründen zu beenden. Dies gilt insbesondere für jegliche Gründe, die einen planmäßigen Ablauf des Gewinnspiels stören oder verhindern würden.
Datenschutz
Für die Teilnahme am Gewinnspiel ist die Angabe von persönlichen Daten notwendig. Der Teilnehmer versichert, dass die von ihm gemachten Angaben zur Person, insbesondere Vor-, Nachname und Emailadresse wahrheitsgemäß und richtig sind.
Der Veranstalter weist darauf hin, dass sämtliche personenbezogenen Daten des Teilnehmers ohne Einverständnis weder an Dritte weitergegeben noch diesen zur Nutzung überlassen werden.
Eine Ausnahme stellt das für die Durchführung des Gewinnspiels beauftragte Unternehmen Happy Contests GmbH dar, welches die Daten zum Zwecke der Durchführung des Gewinnspiels erheben, speichern und nutzen muss.
Im Falle eines Gewinns, erklärt sich der Gewinner mit der Veröffentlichung seines Namens und Wohnorts in den vom Veranstalter genutzten Werbemedien einverstanden. Dies schließt die Bekanntgabe des Gewinners auf der Webseite des Betreibers und seinen Social Media Plattformen mit ein.
Der Teilnehmer kann seine erklärte Einwilligung jederzeit widerrufen. Der Widerruf ist schriftlich an die im Impressumsbereich der Gewinnspiel App angegebenen Kontaktdaten des Veranstalters zu richten. Nach Widerruf der Einwilligung werden die erhobenen und gespeicherten personenbezogenen Daten des Teilnehmers umgehend gelöscht.
Facebook Disclaimer
Diese Aktion steht in keiner Verbindung zu Facebook und wird in keiner Weise von Facebook gesponsert, unterstützt oder organisiert.
Anwendbares Recht
Fragen oder Beanstandungen im Zusammenhang mit dem Gewinnspiel sind an den Betreiber zu richten. Kontaktmöglichkeiten finden sich im Impressumsbereich der Gewinnspiel App.
Das Gewinnspiel des Betreibers unterliegt ausschließlich dem Recht der Bundesrepublik Deutschland. Der Rechtsweg ist ausgeschlossen.
Salvatorische Klausel
Sollte eine Bestimmung dieser Teilnahmebedingungen ganz oder teilweise unwirksam sein oder werden, so wird dadurch die Gültigkeit dieser Teilnahmebedingungen im Übrigen nicht berührt. Statt der unwirksamen Bestimmung gilt diejenige gesetzlich zulässige Regelung, die dem in der unwirksamen Bestimmung zum Ausdruck gekommenen Sinn und Zweck wirtschaftlich am nächsten kommt. Entsprechendes gilt für den Fall des Vorliegens einer Regelungslücke in diesen Teilnahmebedingungen.

Conditions of participation
Participation in the competition organised by Kramer-Werke, hereinafter referred to as the operator or organiser, is free of charge and is governed exclusively by these conditions of participation.
Procedure of the competition
The competition will run from Monday 04/12/2023 to Wednesday 06/12/2023, 24:00.
During this period, users will have the opportunity to take part in the competition online.
Participation
To take part in the competition, it is necessary to complete and submit the entry form displayed. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
Only one submitted entry per participant will be entered into the competition. It is strictly forbidden to use multiple email addresses or multiple Facebook profiles to increase the chances of winning.
Participation in the competition is free of charge.
Eligible participants
Natural persons who are resident in Germany and have reached the age of 14 are eligible to participate. Participation is not restricted to customers of the organiser and is not dependent on the purchase of goods or services.
If a participant has limited legal capacity, the consent of their legal representative is required.
All persons involved in the conception and realisation of the competition and employees of the operator as well as their family members are not eligible to participate in the competition. In addition, the operator reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example
(a) in the event of manipulation in connection with access to or implementation of the competition, (b) in the event of breaches of these conditions of participation, (c) in the event of unfair behaviour or (d) in the event of false or misleading information in connection with participation in the competition.
Prize, notification and transfer of the prize
The following prizes will be awarded: One of ten exclusive Kramer Christmas bauble sets.
The winners will be determined after the closing date for entries as part of a random draw among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the prize draw.
The winners of the prize draw will be informed promptly via a separate message.
The prize will only be handed over to the winner or to the legal representative of the underage winner. It is not possible to exchange, collect or pay out the prize in cash.
Any costs incurred for the dispatch of the prize will be borne by the operator. Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.
If the winner does not respond after two requests within a period of 3 weeks, the prize may be transferred to another participant.
Cancellation of the competition
The organiser expressly reserves the right to terminate the competition without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.
Data protection
Personal data must be provided in order to take part in the competition. The participant assures that the personal details provided, in particular first name, surname and email address, are true and correct.
The organiser points out that none of the participant's personal data will be passed on to third parties or made available to them for use without consent.
An exception to this is the company commissioned to organise the competition, Happy Contests GmbH, which must collect, store and use the data for the purpose of running the competition.
In the event of a win, the winner agrees to the publication of their name and place of residence in the advertising media used by the organiser. This includes the announcement of the winner on the organiser's website and its social media platforms.
The participant can revoke his/her declared consent at any time. The revocation must be sent in writing to the organiser's contact details provided in the legal notice section of the competition app. Once consent has been withdrawn, the participant's personal data that has been collected and stored will be deleted immediately.

Applicable law
Questions or complaints in connection with the competition should be addressed to the operator. Contact details can be found in the legal notice section of the competition app.
The operator's competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
Severability clause
Should any provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
